As part of this effort to enhance the Federal Government's response to lost and stolen firearms, this Administration has recently issued a Notice of Proposed Rule making seeking public comment on the record keeping, data access and retrieval procedures for Federal firearm ownership and tracing data. This proposal was designed to increase the accessibility of this critical data to Federal, State and local law enforcement agents and other individuals who provide firearms safety and tracing services. The Administration is in the initial stages of this process to develop a system that complies with the National Firearms Act of 1934, as amended, and is consistent with the Department of Justice's statutory authority to preserve and make access to trace information as convenient and accessible as possible to users throughout the Federal Government. This proposal is designed to ensure that the records maintained in the system reflect the number, nature and location of the traces as well as the ownership of the firearm, the type of firearm and the date of the trace. In carrying out this proposal, the Office of Management and Budget (OMB) has provided guidance to agencies on the requirements of the National Firearms Act. As an example, the OMB guidelines advise that the records of lost or stolen firearms have the same confidentiality rights and restrictions as those of a firearm transaction covered by the Brady Handgun Violence Prevention Act under the Privacy Act of 1974. In addition, the guidance advises agencies that the Federal Government has primary jurisdiction to enforce the NFL, and that the records of records maintained in the system may be subject to legal challenges based on the Act. Please note that there will be special fees for individuals to submit comments on this proposal.
